Ontario has a specific Hobby Mineral Collecting Policy under which the ministry generally uses enforcement discretion for qualifying non-commercial hobby collecting on eligible land. The policy lists hand tools such as pans, shovels, hammers and chisels, but it does not expressly create a blanket metal-detector permission. If detector use amounts to mineral prospecting outside that policy, the Mining Act prospecting framework applies. Can I use a metal detector for gold in Ontario?

Gold panning and gold detecting are not the same activity
Ontario's Hobby Mineral Collecting Policy can allow qualifying small-scale personal mineral collecting on eligible land without the ministry enforcing the usual prospector-licence requirement, provided the policy conditions are met. It is not a site-specific gold-panning or metal-detector authorization. Mining rights must generally be open for claim registration, required surface/mining-rights consent must be obtained, protected or withdrawn lands remain excluded, and mechanized collecting is outside the policy's enforcement discretion.
Land, claims and mineral rights
Use the public MLAS Map Viewer immediately before field work to identify whether mining rights are open for claim registration, active claims and other current mining-land status. Also determine surface-rights ownership. Ontario's hobby-collecting policy does not override private rights, protected areas, withdrawals, heritage rules or other laws, and a mapped gold occurrence is not itself permission to enter, detect, dig or remove minerals.

Hand-held detector prospecting and disturbance
For qualifying hobby mineral collecting, Ontario's policy describes small-scale personal collecting with hand tools and ministry enforcement discretion under stated conditions. The examples include pans but do not expressly mention metal detectors. Activities outside that policy remain subject to the Mining Act, including prospecting, exploration-plan or permit requirements where applicable. Provincial parks, conservation reserves and other protected or withdrawn lands remain excluded.
